1. Acceptance of Terms
By accessing or using ForeverLoved (the “Platform”), you agree to be bound by these Terms of Use (the “Terms”).
If you do not agree to these Terms, you must not use the Platform.
2. About the Platform
ForeverLoved is a digital platform operated by Lasting Tribute Co. Limited that enables users to create and manage memorial pages in honour of deceased persons, including sharing tributes, photographs, messages, and other commemorative content.
The Platform is intended solely for respectful remembrance and must not be used for unlawful, harmful, or inappropriate purposes.
3. User Accounts
You may be required to create an account to access certain features of the Platform.
You agree to:
- provide accurate and complete information;
- keep your login credentials secure; and
- be responsible for all activity under your account.
The Platform may suspend or terminate accounts that contain false information or are used in breach of these Terms.
4. User Content
4.1 Ownership
You retain ownership of any content you upload (“User Content”).
4.2 Licence to Platform
By uploading User Content, you grant the Platform a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute such content for the purpose of operating and promoting the Platform.
4.3 Responsibility
You are solely responsible for your User Content and its consequences.
5. Content Standards
You agree not to upload or share content that:
- is false, misleading, or defamatory;
- is abusive, offensive, or discriminatory;
- violates the dignity or privacy of any person (including the deceased or their family);
- contains graphic or inappropriate material;
- infringes intellectual property rights; or
- is used for unauthorised commercial purposes.
You further agree not to:
- impersonate any person;
- provide false information;
- interfere with the Platform’s operation or security; or
- use the Platform for unlawful purposes.
All content must be respectful and appropriate to the memorial nature of the Platform.
6. Authority to Create Memorials
You represent that you have the right or consent to create a memorial and upload related content.
The Platform may remove or restrict content where:
- there is a dispute regarding authority; or
- a valid request is made by a family member or authorised representative.
7. Moderation and Removal
The Platform reserves the right, at its discretion, to:
- review, moderate, or remove content;
- suspend or terminate accounts; and
- restrict access to any part of the Platform.
This may occur without prior notice where necessary.
8. Sensitive Content Disclaimer
The Platform contains content relating to death and remembrance, which may be emotional or distressing.
By using the Platform, you acknowledge that:
- you may encounter sensitive material; and
- the Platform is not responsible for any emotional or psychological impact.
9. Privacy
Your use of the Platform is governed by our Privacy Policy.
10. Intellectual Property
All rights in the Platform, including its design, branding, and technology, are owned by or licensed to Lasting Tribute Co. Limited.
You may not copy, modify, or distribute any part of the Platform without prior written consent.
11. Limitation of Liability
To the fullest extent permitted by law, the Platform and Lasting Tribute Co. Limited shall not be liable for:
- any loss arising from User Content;
- inaccuracies in memorial content;
- disputes between users; or
- any indirect, incidental, or consequential damages.
Use of the Platform is at your own risk.
Any liability shall not exceed any amount paid by you (if any) for use of the Platform.
12. No Guarantee of Permanent Storage
The Platform does not guarantee that content will be stored or available indefinitely.
Users are encouraged to retain their own copies.
13. Payments and Services
Where the Platform offers paid services, subscriptions, or contributions:
- you agree to provide accurate payment information;
- you authorise the Platform or third-party providers to process payments; and
- payments are non-refundable unless otherwise stated.
The Platform is not responsible for errors by third-party payment providers.
14. Third-Party Services
The Platform may include links to third-party services.
The Platform is not responsible for their content, services, or practices.
Use of third-party services is at your own risk.
15. Subscriptions
The Platform may offer certain features or services on a subscription basis.
By subscribing, you agree to:
- provide accurate and complete payment information;
- authorise the Platform or its third-party payment providers to charge you for the applicable subscription fees; and
- be responsible for all charges incurred under your subscription.
Subscriptions may be billed on a recurring basis as specified at the time of purchase. You may cancel your subscription at any time; however, cancellation will take effect at the end of the current billing period unless otherwise stated.
All subscription fees are non-refundable unless expressly stated otherwise.
The Platform is not responsible for any errors or failures by third-party payment processors.
16. Free and Premium Features
The Platform may offer both free and paid features.
Free features may be accessed without charge but may have limited functionality. Premium features are available through a paid subscription and may provide additional services, enhanced functionality, or expanded access.
The Platform reserves the right to:
- introduce, modify, or remove free or premium features at any time;
- change which features are available under each category; and
- determine the pricing and availability of premium services.
Access to premium features is subject to payment of the applicable subscription fees and compliance with these Terms.
17. Disputes Between Users
The Platform is not responsible for resolving disputes between users, including disputes relating to memorial ownership or content.
The Platform may restrict or remove content where disputes arise.
18. Termination
The Platform may suspend or terminate your access at any time for breach of these Terms or for any other reason deemed appropriate.
19. Disclaimer of Warranties
The Platform is provided on an “as is” and “as available” basis.
The Platform makes no warranties regarding:
- availability;
- accuracy;
- reliability; or
- fitness for purpose.
Use of the Platform is at your own risk.
20. Indemnity
You agree to indemnify and hold harmless Lasting Tribute Co. Limited and its representatives from any claims, losses, or damages arising from:
- your use of the Platform;
- your User Content; or
- your breach of these Terms.
21. Changes to the Platform
The Platform may modify, suspend, or discontinue any part of its services at any time without notice.
22. Governing Law
These Terms shall be governed by the laws of the Republic of Uganda.
23. Dispute Resolution
Any dispute arising out of or in connection with these Terms shall be resolved through arbitration in Uganda in accordance with the Arbitration and Conciliation Act, Cap. 5.
The arbitration shall be conducted by a single arbitrator agreed upon by the parties, or appointed in accordance with the Act.
The decision of the arbitrator shall be final and binding.
24. Memorial Ownership and Control
A memorial page is created and managed by the user who establishes it (“Memorial Owner”). The Memorial Owner has primary control over the content and management of that memorial page, including the ability to edit, moderate, or remove content.
By creating a memorial, the Memorial Owner represents that they have the appropriate authority, relationship, or consent to do so.
Notwithstanding the above, the Platform recognises that memorials may involve family members or other interested parties. Where a dispute arises regarding the ownership, control, or content of a memorial page, the Platform reserves the right, at its discretion, to:
- restrict access to the memorial;
- suspend editing rights; or
- remove or transfer control of the memorial,
pending resolution of the dispute.
The Platform may consider requests from immediate family members or legally authorised representatives in determining appropriate action but is not obligated to adjudicate or resolve disputes between parties.
The Platform shall not be liable for any claims arising from disputes relating to memorial ownership or control.
25. Amendments
The Platform may update these Terms at any time.
Continued use of the Platform constitutes acceptance of the revised Terms.
